Website Agreement
Thank you for choosing the software products of INFINIUM MEDICAL, INC. Please read and abide by the “INFINIUM MEDICAL, INC. Products User Agreement” (hereinafter called “this agreement”) in order to use the software products of the company. Please carefully read and fully understand each term of this agreement, especially the terms of exclusion or limitation of liability. By obtaining the account number, login, etc. of this product, you are deemed to have read and agreed to be legally bound by this agreement, which is the acceptance of this agreement by default.
I. Scope of This Agreement
This agreement is an agreement about using software products and related services produced by INFINIUM MEDICAL, INC.
II. About NFINIUM MEDICAL's Software Products
NFINIUM MEDICAL's software products refer to all software products and services provided by INFINIUM MEDICAL, INC. to individuals, doctors and users’ friends and relatives. We give users a non-transferable and non-exclusive license to use NFINIUM MEDICAL's software products and services. Any rights not expressly granted to you in this agreement are retained by INFINIUM MEDICAL, INC. and you must obtain additional written permission from us in exercising these rights.
III. User Personal Information
1. We will take reasonable steps to protect our user's personal information. Except as stipulated by laws and regulations, we will not disclose the user's personal information to any organizations other than the partners of INFINIUM MEDICAL, INC. and INFINIUM MEDICAL, INC. without the permission of the user. We use professional encryption storage and transmission of related information to ensure the security of user information.2. Users may need to provide some necessary information during registration or usage. If the information you provide is incomplete or incorrect, your account will not be available or will be restricted during use.
IV. Account Specification and Permissions
1. It is the responsibility of users to keep the registered account information and account password secure. Users are legally responsible for the actions under the registered account. Users need to change the password in time after the initial login to ensure security. Users agree not to disclose the account and password information to others under any circumstances. If you suspect that someone else is using your account, please notify us immediately.2. If the user has not logged in for more than one year, we will not be provided services to avoid wasting resources. Any losses caused by this will be borne by the user.
V. Disclaimer
1. When using NFINIUM MEDICAL's software products, our company will use the processor and bandwidth resources of your mobile communication terminal. In the process of using software products of INFINIUM MEDICAL, INC., data traffic charges may occur. Users need to know the relevant price information from carrier and bear the relevant expenses.
2. We will do our best to ensure your data storage security in the process of using NFINIUM MEDICAL's software products. However, we cannot offer complete guarantees for this, including but not limited to the following situations:
(1) We are not responsible for the deletion or storage failure of your data in NFINIUM MEDICAL's software products.
(2) We have the right to determine the maximum storage period of the data of a single user in NFINIUM MEDICAL's software products according to the actual situation, and to allocate the maximum storage space for the data on the server. You can back up the relevant data in NFINIUM MEDICAL's software products according to your own needs.
(3) If you stop using NFINIUM MEDICAL's software products or are terminated or canceled, we have the right to permanently delete your data from the server. We are not obligated to return any data to you after the service has been stopped, terminated or canceled.
3.When using the NFINIUM MEDICAL's software products, users are responsible for the following risks of uncontrollable content, including but not limited to:
(1) Risks of personal information loss, leakage, etc. due to irresistible factors.
(2) When users use NFINIUM MEDICAL's software products to access third party websites, the risks caused by third party websites and related content shall be borne by the users themselves.
(3) Risks and responsibilities arising from the dissemination of user-posted content forwarded and shared by others.
(4) Risks of login failure, incomplete data synchronization, and slow page opening caused by the instability of the wireless network signal and the small bandwidth of the wireless network.
(5) Access failure or data loss caused by failure of other third party platforms (such as carrier platforms, etc.).
(6) Risks and responsibilities for users not being able to obtain relevant data due to non-human factors.
VI. Content and Code of Conduct
User shall not use the account to create, copy, post or disseminate the following content that interferes with normal operation of our services, violates national laws, and infringes the legitimate rights and interests of other users or third parties, including but not limited to:
1.Post, transmit, disseminate, or store content that violates national laws, endangers national security, social stability, public order, good social morality, or includes insult, defamation, obscenity, or any sexual or sexually suggestive or violent.
2.Post, transmit, disseminate, or store content that infringes upon legitimate rights of others such as reputation, portrait, intellectual property, trade secrets, etc.
3.Any activities involving the privacy, personal information or materials of others.
4.Post, transmit, disseminate harassment, advertising information and spam.
5.Information that violates laws, regulations, policies, public order, good social morality, or interferes with the normal operation of NFINIUM MEDICAL and infringes the legitimate rights and interests of other users or third parties.
6. Use, rent, lend, copy, modify, link, reprint, compile, post, publish, create mirror sites, etc. of content that we own intellectual property rights.7.Copy, modify, add, delete, mount, or create any derivative work of the data NFINIUM MEDICAL's software released into any terminal, the interactive data between the client and the server during the running process, and the system data necessary to run NFINIUM MEDICAL's software products, including but not limited to access to the software and related systems using plug-ins or non-authorized third party tools/services.8.Users, authorized others or third parties interfere with the software, its components, modules, and data.9.Other acts not expressly authorized.
VII. Breach of Agreement
1.Users must be responsible for all actions under their own registered account, including any content you post and any consequences arising therefrom. You should judge the content of NFINIUM MEDICAL's software products and assume all risks arising from the use of it, including risks arising from the reliance on the correctness, completeness or usefulness of it. We cannot and shall not be liable for any losses or damage caused by the above risks.
2.You shall be solely responsible for any claim, demand or loss claimed by a third party due to your breach of this agreement or the relevant terms of service. If we suffer losses, you should also compensate us together.
VIII. Security Responsibility
Like most Internet/mobile Internet services, NFINIUM MEDICAL's software products may be affected by many factors, including but not limited to user reasons, network service quality, social environment, etc. It may also be plagued by various security issues, including but not limited to illegal use of user data by others for real-world harassment. Other software downloaded and installed or websites visited by users may contain viruses, Trojans or other malicious programs that threaten your terminal device information and data security, which in turn affects the normal use of the software. Therefore, you should strengthen the consciousness of information security and personal information protection, such as password protection, so as not to suffer losses.Maintaining software security and normal use is our shared responsibility. We will take reasonable and prudent measures to protect your terminal equipment information and data security in accordance with industry standards. However, you acknowledge and agree that we cannot offer complete guarantees for this.Under no circumstances should you believe in borrowing, asking for passwords or other network information related to property. If you are involved in property operations, please check the identity of others first. And always pay attention to the tips on preventing fraud.
IX. Others
1.Your use of any software products produced by INFINIUM MEDICAL, INC. is deemed to have been read and agreed to be bound by this agreement. We reserve the right to modify the terms of this agreement as necessary. Your continued use of the software after such modification shall be deemed to be your acceptance of any such modification. If you do not agree to any modification of this agreement, you should stop using the software products produced by INFINIUM MEDICAL, INC.
2.The establishment, entry into force, performance, interpretation and dispute resolution of this agreement shall be governed by the laws of the United States.
3.Any dispute or controversy between you and us shall be settled through friendly negotiation first. Should such negotiations fail, you would agree to submit the dispute or controversy to the people's court having jurisdiction where the agreement is signed.
4.The headings of all the terms of this agreement are for convenience of reading only and have no actual meaning and cannot be used as a basis for interpretation of the meaning of this agreement.5.If the terms of this agreement are partially invalid or unenforceable for any reason, the remaining terms shall still be valid and binding on both parties.
